Terms of Use

These terms are the agreement between you and Zero Lotus Ltd for using LumaBeat. They are written to be read, not to be survived. Using the app means you accept them.

Who you are agreeing with

LumaBeat is operated by Zero Lotus Ltd, a company registered in England and Wales, company number 17417595 (“we”, “us”). These terms cover the LumaBeat mobile app, the browser-based guest page, and the server that connects them (the “relay”) — together, the “Service”.

If you do not agree with these terms, do not use the Service.

Photosensitivity and safe use

LumaBeat deliberately produces rapid flashing light. A small number of people may experience epileptic seizures, migraines, dizziness, or disorientation when exposed to flashing lights or patterns, even with no previous history and no prior diagnosis. If you or anyone who may see the show has any history of seizures or photosensitivity, do not run a strobing show.

The app shows a photosensitivity warning before any strobing content is reachable, and you must acknowledge it to continue. Every device can join in a no-strobe mode, which renders soft, non-flashing effects instead; this can be turned on in Settings and changed during a show. The host can black out every phone in the room instantly at any time.

By running a show you accept that you are the one responsible for the room. That means telling the people present that flashing light is about to start, giving anyone who wants to leave the chance to do so, and stopping the show if anyone becomes unwell.

You also agree not to:

LumaBeat drives the camera flash and the screen at full brightness, which makes phones warm and drains batteries quickly. The app eases off automatically when a phone gets hot and drops it from flash duty below 20% battery, but you should still place phones where they have air around them, and not leave them on soft furnishings, under fabric, or in a pocket while a show runs.

Your licence to use LumaBeat

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service on devices you own or control, for your own non-commercial use. You may not copy, modify, reverse-engineer, decompile, resell, rent, or redistribute the app, except where that restriction is prohibited by law.

We keep all rights in the Service, including the LumaBeat name and its designs, that we do not expressly grant here.

What it costs

LumaBeat is free. Hosting a show and joining one cost nothing: unlimited parties with up to 32 phones in the room, and no in-app purchases or subscriptions.

If we ever introduce paid features, we will update these terms before they are offered, and the price will be shown in the app before you are asked to pay anything.

Accounts, guests, and what people type

There are no accounts. Access to a show works through short-lived capability tokens issued per room, as described in our Privacy Policy. Anyone holding a room's join code can join that show, so share the QR code only with the people you want in the room.

If you use party invitations, guests may type a display name and optionally a contact detail. You are responsible for what you submit, and for not submitting anyone else's personal information without their agreement. We may remove content that is unlawful, abusive, or impersonates someone.

We may withdraw access to the Service, or remove a room or party, if it is being used in breach of these terms.

The Service is provided as it is

The relay is a small server operated on a best-effort basis. It has no guaranteed uptime, and we may change, suspend, or discontinue any part of the Service at any time. Shows depend on your local network and on the phones taking part; synchronisation quality will vary with Wi-Fi conditions, device performance, and how many phones are in the room.

To the fullest extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limits on our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Your statutory rights as a consumer are not affected.

Subject to that, to the fullest extent permitted by law we are not liable for indirect or consequential loss, loss of data, loss of profit, or damage to devices arising from use of the Service; and our total liability arising out of or in connection with the Service is limited to the amount you have paid for it in the twelve months before the claim arose, or nil if you have paid nothing.

Third-party technology

LumaBeat includes Ableton Link, used under Ableton's Link SDK licence, to synchronise with DJ software running on the same network. Distribution through the App Store is also subject to Apple's terms. Apple is not a party to these terms, has no obligation to provide support for LumaBeat, and is not responsible for the Service.

Changes to these terms

We may update these terms. When we do, we will change the date at the top of this page, and note anything significant in the app's release notes. Continuing to use the Service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your own country's law.
